　The Regulation on Governments" Supervisory Inspection, as adopted at the 116th executive meeting of the State Council on December 1, 2020, is hereby issued, and shall come into force on February 1, 2021. 《政府督查工作条例》已经2020 年 12 月 1 日国务院第 116次常务会议通过，现予公布，自 2021年 2 月 1 日起施行。

　Premier: Li Keqiang 总 理 李克强 December 26, 2020 2020 年 12 月 26 日 Regulation on Governments" Supervisory Inspection 政府督查工作条例 Article 1 This Regulation is developed for the purposes of strengthening and regulating governments" supervisory inspection, guaranteeing the smooth implementation of government orders, enhancing administrative efficiency, promoting government integrity, and improving the rules of administrative supervision. 第一条

　为了加强和规范政府督查工作，保障政令畅通，提高行政效能，推进廉政建设，健全行政监督制度，制定本条例。

　Article 2 For the purposes of this Regulation, “governments" supervisory inspection” means supervision and inspection organized by people"s governments at or above the county level within the 第二条

　本条例所称政府督查，是指县级以上人民政府在法定职权范围内根据工作需要组织开展的监督检查。

　 II scope of their statutory powers as required for work. Article 3 Governments" supervisory inspection shall adhere to and strengthen the leadership of the Party, be people-oriented, serve the overall situation, seek truth from facts, promote administration by law, promote the implementation of policies and the settlement of problems, and avoid formalism and bureaucratism. 第三条

　政府督查工作应当坚持和加强党的领导，以人民为中心，服务大局、实事求是，推进依法行政，推动政策落实和问题解决，力戒形式主义、官僚主义。

　Article 4 The contents of governments" supervisory inspection shall include: 第四条

　政府督查内容包括：

　(1) the implementation of major decisions and arrangements of the CPC Central Committee and the State Council; （一）党中央、国务院重大决策部署落实情况； (2) the implementation of important work arrangements of people"s governments at higher levels and at the same level; （二）上级和本级人民政府重要工作部署落实情况； (3) performance of statutory duties by the subjects of supervisory inspection; and （三）督查对象法定职责履行情况； (4) administrative efficiency of departments of people"s governments at the same level and people"s governments at lower levels. （四）本级人民政府所属部门和下级人民政府的行政效能。

　Article 5 The subjects of governments" supervisory inspection include: 第五条

　政府督查对象包括：

　(1) the departments of people"s governments at the same level; （一）本级人民政府所属部门； (2) people"s governments at lower levels and their departments; （二）下级人民政府及其所属部门； (3) organizations authorized by laws and regulations to perform the function of administering public affairs; and （三）法律、法规授权的具有管理公共事务职能的组织； (4) organizations entrusted by administrative agencies to administer public affairs. （四）受行政机关委托管理公共事务的组织。

　The people"s government at a higher level may conduct supervisory inspection of the people"s government at a lower level and its departments, and may, when necessary, conduct supervisory inspection of people"s governments at all levels and their departments under its jurisdiction. 上级人民政府可以对下一级人民政府及其所属部门开展督查，必要时可以对所辖各级人民政府及其所属部门开展督查。

　Article 6 The General Office of the State Council 第六条

　 III shall guide the supervisory inspection of governments nationwide and organize the supervisory inspection of the State Council. The supervisory inspection body of the General Office of the State Council shall undertake the specific work relating to the supervisory inspection of the State Council. 政府督查工作，组织实施国务院督查工作。国务院办公厅督查机构承担国务院督查有关具体工作。

　The supervisory inspection bodies of local people"s governments at or above the county level shall organize the supervisory inspection of people"s governments at the same level. The forms and specifications for the setup of supervisory inspection bodies of local people"s governments at or above the county level shall be governed by the provisions on the administration of institution setup. 县级以上地方人民政府督查机构组织实施本级人民政府督查工作。县级以上地方人民政府督查机构设置的形式和规格，按照机构编制管理有关规定办理。

　The supervisory inspection bodies of the General Office of the State Council and local people"s governments at or above the county level are collectively referred to as governments" supervisory inspection bodies. 国务院办公厅督查机构和县级以上地方人民政府督查机构统称政府督查机构。

　Article 7 The people"s governments at and above the county level may designate their departments to conduct governments" supervisory inspection according to the designated matters, scope, duties and time limit. 第七条

　县级以上人民政府可以指定所属部门按照指定的事项、范围、职责、期限开展政府督查。

　The departments of people"s governments at and above the county level shall not conduct governments" supervisory inspection without designation by people"s governments at the same level. 县级以上人民政府所属部门未经本级人民政府指定，不得开展政府督查。

　Article 8 The people"s government at or above the county level may dispatch a supervisory inspection group as required for work. The supervisory inspection group shall conduct the government"s supervisory inspection according to supervisory inspection matters, scope, duties and time limit determined by the people"s government at the same level. The supervisory inspection group shall be responsible to the people"s government at the same level. 第八条

　县级以上人民政府根据工作需要，可以派出督查组。督查组按照本级人民政府确定的督查事项、范围、职责、期限开展政府督查。督查组对本级人民政府负责。

　The group leader shall assume overall responsibility for the supervisory inspection group and the group leader shall be determined by the people"s government at the same level. 督查组实行组长负责制，组长由本级人民政府确定。

　 IV Deputies to the people"s congress, members of the political consultative conference, government counselors, experts and scholars, among others, may be invited to join the supervisory inspection group. 可以邀请人大代表、政协委员、政府参事和专家学者等参加督查组。

　Article 9 Supervisory inspectors shall possess the political quality, work style, professional knowledge, professional competence and legal literacy commensurate with supervisory inspection they engage in, abide by the Constitution and laws, be devoted to their duties, be impartial, honest and upright, keep secrets confidential, and consciously accept supervision. 第九条

　督查人员应当具备与其从事的督查工作相适应的政治素质、工作作风、专业知识、业务能力和法律素养，遵守宪法和法律，忠于职守、秉公持正，清正廉洁、保守秘密，自觉接受监督。

　Governments" supervisory inspection bodies shall provide political, theoretical and business training to supervisory inspectors. 政府督查机构应当对督查人员进行政治、理论和业务培训。

　Article 10 The funds necessary for governments" supervisory inspection bodies to perform their duties shall be included in the budget at the same level. 第十条

　政府督查机构履行职责所必需的经费，应当列入本级预算。

　Article 11 Governments" supervisory inspection bodies shall determine supervisory inspection matters according to the decisions of people"s governments at the same level or the orders given by the chief executives of people"s governments at the same level within the scope of their powers. 第十一条

　政府督查机构根据本级人民政府的决定或者本级人民政府行政首长在职权范围内作出的指令，确定督查事项。

　Governments" supervisory inspection bodies may, according the major decisions and arrangements of the CPC Central Committee and the State Council, the important work arrangements of people"s governments at higher levels and at the same level as well as the clues obtained, offer supervisory inspection suggestions and determine supervisory inspection matters with the approval of the chief executive of the people"s government at the same level. 政府督查机构根据党中央、国务院重大决策部署，上级和本级人民政府重要工作部署，以及掌握的线索，可以提出督查工作建议，经本级人民政府行政首长批准后，确定督查事项。

　Article 12 Governments" supervisory inspection may be conducted in the following ways: 第十二条

　政府督查可以采取以下方式：

　(1) Requiring the subjects of supervisory inspection to conduct self-inspection and give explanations. （一）要求督查对象自查、说明情况； (2) Listening to the reports of the subjects of supervisory inspection. （二）听取督查对象汇报； (3) Conducting inspections, holding interviews and （三）开展检查、访谈、暗

　 V secret interviews. 访； (4) Organizing discussions, hearings, statistics and appraisal. （四）组织座谈、听证、统计、评估； (5) Consulting and duplicating the materials relating to supervisory inspection matters. （五）调阅、复制与督查事项有关的资料； (6) Collecting clues through channels such as letters, phone calls and media. （六）通过信函、电话、媒体等渠道收集线索； (7) Holding interviews with the persons in charge of the subjects of supervisory inspection or relevant liable persons. （七）约谈督查对象负责人或者相关责任人； (8) Conducting “Internet + supervisory inspection” by means of modern information technology means. （八）运用现代信息技术手段开展“互联网＋督查”。

　Article 13 Where assistance is needed in governments" supervisory inspection, relevant administrative agencies shall provide assistance within the scope of their powers. 第十三条

　政府督查工作需要协助的，有关行政机关应当在职权范围内予以协助。

　Article 14 People"s governments at or above the county level may organize comprehensive supervisory inspection, special supervisory inspection, incident investigation, routine oversight, clue verification and other governments" supervisory inspection. 第十四条

　县级以上人民政府可以组织开展综合督查、专项督查、事件调查、日常督办、线索核查等政府督查工作。

　Article 15 In governments" supervisory inspection, supervisory inspection plans shall be made, supervisory inspection content, subjects and scope shall be specified; supervisory inspection frequency and time limit shall be strictly controlled, supervisory inspection methods shall be applied in a scientific manner, supervisory inspection discipline shall be enforced, and supervisory inspectors shall be trained in advance. 第十五条

　开展政府督查工作应当制定督查方案，明确督查内容、对象和范围；应当严格控制督查频次和时限，科学运用督查方式，严肃督查纪律，提前培训督查人员。

　Governments" supervisory inspection shall be carried out in strict accordance with the supervisory inspection plan, the scope of supervisory inspection shall not be enlarged without approval, the subjects and contents of supervisory inspection shall not be modified, the normal work of the subjects of supervisory inspection shall not be intervened, and repeated, multiple or ultra vires supervisory inspection are prohibited. 政府督查工作应当严格执行督查方案，不得随意扩大督查范围、变更督查对象和内容，不得干预督查对象的正常工作，严禁重复督查、多头督查、越权督查。

　 VI Article 16 People"s governments at or above the county level shall make supervisory inspection conclusions after the completion of governments" supervisory inspection. The supervisory inspection conclusions relating to the subjects of supervisory inspection shall be sent to the subjects of supervisory inspection. 第十六条

　县级以上人民政府在政府督查工作结束后应当作出督查结论。与督查对象有关的督查结论应当向督查对象反馈。

　The supervisory inspection conclusions shall be based on clear facts, sufficient evidence, objective and impartial. 督查结论应当事实清楚，证据充分，客观公正。

　Article 17 Where the subject of supervisory inspection has any objection to the supervisory inspection conclusion, it may, within 30 days as of the receipt of the conclusion, apply to the people"s government that makes the supervisory inspection conclusion for review. The people"s government receiving the application shall make a review decision within 30 days. Any staff member who participates in making the supervisory inspection conclusion shall withdraw from the review. 第十七条

　督查对象对督查结论有异议的，可以自收到该督查结论之日起 30 日内，向作出该督查结论的人民政府申请复核。收到申请的人民政府应当在 30 日内作出复核决定。参与作出督查结论的工作人员在复核中应当回避。

　Article 18 The subject of supervisory inspection shall take corrective action as required for the matter that shall be corrected in the supervisory inspection conclusion. The governments" supervisory inspection body may, as required for work, inspect it on its corrective action taken. 第十八条

　对于督查结论中要求整改的事项，督查对象应当按要求整改。政府督查机构可以根据工作需要，对整改情况进行核查。

　Article 19 A governments" supervisory inspection body may, according to the supervisory inspection conclusion, offer suggestions on modifying or revoking inappropriate regulatory documents such as decisions and orders of people"s governments at the same or lower levels and their departments, and report it to the people"s government at the same level or the chief executive of the people"s government at the same level. 第十九条

　政府督查机构可以根据督查结论，提出改变或者撤销本级或者下级人民政府及其所属部门不适当的决定、命令等规范性文件的建议，报本级人民政府或者本级人民政府行政首长。

　Article 20 A governments" supervisory inspection body may conduct investigation and research on prominent issues reflected in the supervisory inspection conclusion, and report the investigation and research information to the people"s government at the same level or the chief executive of the people"s government at the same level in a truthful and accurate manner. 第二十条

　政府督查机构可以针对督查结论中反映的突出问题开展调查研究，真实准确地向本级人民政府或者本级人民政府行政首长报告调查研究情况。

　 VII Article 21 A governments" supervisory inspection body may, based on the supervisory inspection conclusion or the results of corrective action and inspection, offer suggestions on commending, motivating, or criticizing the subjects of supervisory inspection in accordance with laws and regulations, and organize the implementation of such suggestions with the approval of the people"s government at the same level or the chief executive of the people"s government at the same level. 条 第二十一条

　政府督查机构可以根据督查结论或者整改核查结果，提出对督查对象依法依规进行表扬、激励、批评等建议，经本级人民政府或者本级人民政府行政首长批准后组织实施。

　A governments" supervisory inspection body may, based on the supervisory inspection conclusion or the results of corrective action and inspection, offer suggestions on holding the subjects of supervisory inspection liable in accordance with laws and regulations and report it to the competent authority for investigation and handling with the approval of the people"s government at the same level or the chief executive of the people"s government at the same level. 政府督查机构可以根据督查结论或者整改核查结果，提出对督查对象依法依规追究责任的建议，经本级人民政府或者本级人民政府行政首长批准后，交有权机关调查处理。

　Article 22 The coordination and connection between governments" supervisory inspection and administrative law enforcement supervision and recordation examination supervision, among others, shall be strengthened. 条 第二十二条

　政府督查应当加强与行政执法监督、备案审查监督等的协调衔接。

　Article 23 Where any clue to a suspected duty-related violation of law or crime by public officials, such as corruption, bribery, dereliction of duty and malpractice, is discovered in supervisory inspection, the governments" supervisory inspection body shall transfer the case to the supervisory organ, which shall conduct investigation and handling in accordance with the law; and transfer the clue to any other suspected crime found to the judicial organ for handling in accordance with the law. 条 第二十三条

　督查工作中发现公职人员涉嫌贪污贿赂、失职渎职等职务违法或者职务犯罪的问题线索，政府督查机构应当移送监察机关，由监察机关依法调查处置；发现涉嫌其他犯罪的问题线索，移送司法机关依法处理。

　Article 24 Where a governments" supervisory inspection body or any of its supervisory inspectors, in violation of the provisions of this Regulation, abuses power, practices favoritism or makes falsification, neglects duty, or divulges any state secret, trade secret or personal privacy obtained during the process of supervisory inspection, or violates the provisions on government integrity, the liable 条 第二十四条

　政府督查机构及督查人员违反本条例规定，滥用职权、徇私舞弊、玩忽职守的，泄露督查过程中所知悉的国家秘密、商业秘密、个人隐私的，或者违反廉政规定的，对负有责任的领导人员和直接责任人员依法依规给予处理；

　 VIII executive in charge and directly liable persons shall be punished in accordance with laws and regulations; and if it is criminally punishable, the offender shall be held criminally liable in accordance with the law. 构成犯罪的，依法追究刑事责任。

　Article 25 The subjects of supervisory inspection and their staff members shall not obstruct the supervisory inspection, conceal the truth, practice fraud, or forge, conceal or destroy evidence. Whoever falls under any of the aforesaid circumstances shall be ordered by the governments" supervisory inspection body to take corrective action; and if the circumstances are serious, shall be held liable in accordance with laws and regulations. 条 第二十五条

　督查对象及其工作人员不得阻碍督查工作，不得隐瞒实情、弄虚作假，不得伪造、隐匿、毁灭证据。有上述情形的，由政府督查机构责令改正；情节严重的，依法依规追究责任。

　Article 26 Where any supervisory inspector or any entity or individual that provides any clue or reports any information is threatened, attacked, retaliated against or framed up, the violator shall be held liable in accordance with laws and regulations. 条 第二十六条

　对督查人员或者提供线索、反映情况的单位和个人进行威胁、打击、报复、陷害的，依法依规追究责任。

　Article 27 Other supervisory inspection conducted by people"s governments at or above the county level and their departments shall be governed by the provisions of relevant laws and administrative regulations. 条 第二十七条

　县级以上人民政府及其所属部门依照有关法律法规开展的其他监督检查，按照有关法律法规规定执行。

　Article 28 This Regulation shall come into force on February 1, 2021. 第二十八条

　本条例自 2021 年2 月 1 日起施行。
